娱美德起诉三七互娱《传奇霸业页游》、《传奇霸业手游》著作权侵权和不正当竞争
> Wemade Entertainment Sues 37 Games for Copyright Infringement and Unlawful Competition for Its Chuanqi Baye Games
因认为三七互娱(上海)科技有限公司(下称三七互娱)运营的RPG类游戏《传奇霸业页游》和《传奇霸业手游》涉嫌侵犯知名游戏《热血传奇》的著作权，且游戏内容涉嫌构成不正当竞争，娱美德将其分别起诉至北京和上海某法院。目前，两地法院均已经受理该案。
Wemade Entertainment Co., Ltd (“Wemade”) submitted complaints against 37 Interactive Entertainment (Shanghai) Technology Co., Ltd. (“37 Games”) and its ‘Chuanqi Baye Web Game’ and ‘Chuanqi Baye Mobile Game’ for copyright infringement and unlawful competition of MIR 2 (热血传奇 Rexue Chuanqi) in both Beijing and Shanghai courts. Both courts have admitted the case.
《热血传奇》是韩国娱美德公司开发的一款MMORPG类PC端游戏。
MIR 2(热血传奇 Rexue Chuanqi) is the massively popular MMORPG PC Client Game which was developed by Wemade.
娱美德认为，三七互娱在未经著作权人娱美德和亚拓士任何授权的情况下，开发《传奇霸业页游》和《传奇霸业手游》在其三七游戏平台上架运营。经比对，从游戏内容来看，《传奇霸业页游》和《传奇霸业手游》均与《热血传奇》高度相似。此外，三七互娱在上线运营《传奇霸业页游》和《传奇霸业手游》时，为达到其宣传推广的目的，宣称其运营的游戏是“传奇的官方授权游戏”。
According to Wemade, 37 Games illegally developed and operated the web and mobile versions of Chuanqi Baye on its platform without any authorization from the licensors, Wemade or Actoz Co., Ltd. By analyzing and comparing the contents of both games, it has been found to be substantially similar to MIR 2. Moreover, 37 Games had once claimed that Chuanqi Baye Mobile Game is “the official mobile game of the Chuanqi series”, which was in fact one of the many tricks that 37 Games has used to achieve stellar marketing results in its operation of the game.
娱美德认为，三七互娱的上述行为，极易对玩家造成混淆，让玩家误以为是《热血传奇》的官方游戏，不仅侵犯了《热血传奇》游戏的著作权，且构成了不正当竞争行为。针对三七互娱的侵权行为，娱美德作为《热血传奇》的原始著作权人，有权向法院提起诉讼。目前，《传奇霸业页游》正在继续运营，而《传奇霸业手游》则处在预约阶段。
Such conduct from 37 Games creates confusion to the numerous fans of the IP, who might mistakenly believe that 37 Games’ mobile game is the official MIR 2 Mobile Game; therefore it constitutes copyright infringement and unlawful competition of MIR 2. Wemade, as the original developer and IP owner of the MIR 2 franchise, is exercising its legal right, by filing a litigation against 37 Games for its infringing conduct. At the current moment, Chuanqi Baye Web Game is in service, and Chuanqi Baye Mobile Game’s pre-registration site is open to the public.

近期，我们发现市面上出现了一些侵犯《热血传奇》相关知识产权、甚至制造虚假言论蒙骗玩家的伪劣非法页游和手游产品，在未经著作权人娱美德和亚拓士任何授权的情况下，盗用热血传奇游戏元素进行游戏开发，并以极易对玩家造成混淆的方式对产品进行传播，诱导用户以达到吸引用户下载体验进而谋取不正当商业利益的目的。
娱美德作为热血传奇的著作权人，对于侵权行为决不姑息，坚决打击盗版侵权产品。目前，娱美德已针对上述侵权方正式提起诉讼，法院已立案受理。在此，娱美德郑重声明，娱美德是通过全资子公司拥有《热血传奇》全部知识产权的原始权利人，且有权进行独立维权。
